Lodging an Enduring Power of Attorney with Landgate

IMPORTANT INFORMATION
When preparing a new EPA please ensure at least two originals are created. The EPA document/s can be deposited with Landgate by lodging two originally signed documents. Landgate will retain one original document and the second will be returned to the lodging party. If there is only one originally signed EPA, then that originally signed document will be retained by Landgate as part of the permanent records. Photocopies of EPA documents are not acceptable for registration purposes.
ENDURING POWER OF ATTORNEY
An Enduring Power of Attorney (EPA) document only needs to be registered with Landgate, if the attorney is to transact on property in WA that is owned by the donor or that the donor has interests in. The EPA is required to be registered with Landgate prior to the attorney signing and lodging any documents dealing with the Donor’s land or the Donor’s interest in land. Please note if the donor of the EPA passes away, the EPA ceases to have any legal power and cannot be used.
If the EPA was signed more than three months prior to registration, a statutory declaration from ALL of the attorney’s (Donees) including any substitute’s or from the DONOR will be required. Examples of the Declaration(s) are attached for your assistance.
PLEASE NOTE:
If the EPA is being signed outside of Australia, the witness(es) is/are required to be someone who can witness a statutory declaration (outside Australia).
REGISTRATION FEES
Registration fees are payable on lodgement of any application. The fee for lodging an EPA is currently $216.60.
If posting document/s to Landgate it is important to include any registration fee payable. A Postal Lodgement Coversheet can be sourced from Landgate and enables you to select one of the payment options available.

LODGING AT LANDGATE
Please do not email the documentation back, it will need to be lodged with Landgate.
When you’re ready to lodge your documents at Landgate, you can choose to lodge in person at the Landgate offices located in either Midland or Perth, or by post.
It is not necessary to make an appointment to lodge your documents.
Once lodged you can track the progress of your case using the NotifyMe free service which can be found on the Landgate website.
