Independent Estate Administration

Independent Estate Administration is an area of law where an independent administrator is appointed to administer a deceased estate. They are usually a lawyer or other suitably qualified professional. They can be appointed on a permanent or interim basis. An independent estate administrator can be useful where parties are in dispute, distrust each other, are unable to cooperate or communicate effectively, or to simply avoid the likelihood of this occurring where there are large numbers of beneficiaries or complex matters to contend with.

Bayside Legal is experienced in working with individuals and families across estate administration, from beginning to end. We can apply for grants of probate or letters of administration, manage the administration of the estate and distribution of the estate to any named or entitled beneficiaries, under the law. We can help to manage disputes by mediating, advising and preparing Deeds of Family Arrangement (or other related documents where necessary). Lastly, we can help to wind up an estate and file a final statement of assets and liabilities (detailing the distribution of the estate) with the Supreme Court of Western Australia.
