Bayside Legal offers a comprehensive and independent estate administration service throughout Western Australia. Our team assists executors, administrators, and families with all aspects of managing a deceased estate — from the initial application for a Grant of Probate or Letters of Administration, through to the final distribution of assets to beneficiaries.
In Western Australia, the administration of a deceased estate is governed primarily by the Administration Act 1903 (WA) and relevant Supreme Court procedures. The process typically involves:
Identifying and valuing assets: Locating all property, financial accounts, and personal effects belonging to the deceased, and obtaining valuations where required.
Obtaining a Grant of Probate or Letters of Administration: Probate confirms the authority of the executor to administer the estate when a valid will exists. If there is no will, Letters of Administration are required to appoint an administrator who will then has the legal right to deal with the deceased’s estate according to the law.
Collecting and protecting estate assets: Ensuring all assets are secured, debts are identified, and any ongoing financial obligations (such as mortgages or utilities) are appropriately managed.
Paying liabilities and taxes: Settling outstanding debts, funeral expenses, and taxation requirements, including capital gains tax or final income tax returns.
Distributing the estate: Transferring assets or funds to beneficiaries according to the will or, if there is no will, under the laws of intestacy in Western Australia.

Family Provision Claims
Family provision claims, or estate litigation as it is also sometimes referred to, is an area of law concerned with making a claim for provision from a deceased estate, or alternatively, defending against a claim made against an estate.
These claims fall under the jurisdiction of the Supreme Court of WA and are made by people who think that they have standing under the law to make a claim, and therefore may be entitled to receive a portion of a deceased estate (if they have not been provided for) or to receive a larger proportion of an estate than what they have been left.
‘The other side of the coin’ is as an Executor or Administrator of a deceased estate, you may be required to answer or defend a claim for family provision made against an estate that you are responsible for winding up and distributing.
