Pension Card Holders
If you are the holder of a valid pension card, then certain discounts apply as follows:
Initial Consultation - $250.00 (as opposed to $495.00)
15% discount on all legal work.
Please note that we cannot offer a discount on disbursements, statutory filing fees and Court filing fees.
Standard or simple Wills
Standard or simple Wills are for people with non-complex estates and whose entire estate is situated in Australia. Estates including complex matters, such as like testamentary trusts, overseas assets or other matters requiring more complex advice and drafting may not be suitable for a standard or simple Will.
Standard Will - includes taking of instructions, provision of legal advice relevant to your personal circumstances, preparation of your draft, review of your draft with a lawyer to ensure that you understand the Will and to confirm that it is according to your instructions, finalisation of your Will, facilitation of Will Execution Meeting, binding of your original Will, provision of a certified copy and supporting information on the safe storage of your Will - from $990.00 (per person).
Standard Couple Wills - the service as above, however, a couple is requested to sign a waiver acknowledging that they are happy to provide their instructions in the company of each - from $1700.00 (per couple).
Complex Will (usually including a Testamentary Trust, blended families, overseas assets, provisions for businesses or companies or Special Disability Trust)
Complex wills are recommended for clients who have complex estates. This can take many forms and usually includes the drafting of at least one testamentary trust.
Circumstances where complex wills are recommended or required include where provisions for family trusts, or other trusts that are desired or recommended, businesses or companies, families or individuals who have overseas assets, blended families, families who have a child living with a disability and require advice and drafting in relation to certain provisions around guardianship or special disability trusts; Wills that require guardianship provisions, Rights to Reside and other such provisions.
These Wills are scoped out and estimates provided following an initial consultation.
This comprehensive service includes all services as set out for Standard Wills (above) as well as the bespoke advice and drafting as required or desired in your personal circumstances. Complex Wills start from $1600.00 per person.
Advance Care Planning
Enduring Power of Attorney from $450.00 per person.
This service includes an initial meeting to provide advice about the various roles and options, take instructions. This is followed by the preparation of documents, review of documents by client, finalisation of documents, provision of bound originals and certified copies (where Landgate registration is required, provision of bound originals will be following registration with Landgate) (plus Landgate registration fee and outside clerk fee to register EPA).
Enduring Power of Guardianship from $650.00.
Enduring Powers of Guardianship are more complex documents which take more time in taking instructions and providing advice, which is reflected in the fee. This service includes an initial meeting to provide advice about the various roles and options, take instructions. This is followed by the preparation of documents, review of documents by client, finalisation of documents, provision of bound originals and certified copies and information about storage and provision to GP or other services.

Couple package from $2800.00
Standard Will, Enduring Power of Attorney and Enduring Power of Guardianship.
Application for grant of probate or grants of letter of administration
Application for grant of probate from $1,485.00 (plus court filing fee of $418.00).
This service includes meeting with the client to take instructions, provide advice liaising with client as may be reasonably necessary, the drafting of the application for probate and filing in the Supreme Court Probate Registry.
Application for a grant of letters of administration from $1,885.00 (plus court filing fees of $418.00).
This service includes meeting with the client to take instructions, provision of advice, liaising with the client (and potentially the beneficiaries as reasonably required to facilitate the preparation of any required consents) drafting of the application and filing in the Supreme Court Probate Registry.
Estate Administration Services:
Commences with an initial consultation which includes identification of legal issues and preliminary advice. Fee for initial consultation (approx 1 hour consultation) $495.00.
Estimate for ongoing representation in a matter is provided at the conclusion of the initial consultation.
Family Provision Claims: challenging a will and other estate-related litigation:
Estimate to be provided at the conclusion of the initial consultation.
Binding Financial Agreements - from $6,000.00.
Estimate to be provided at initial consultation.
Application for guardianship and administration in the State of Administration Tribunal - from $990.00
Following the initial consultation, work included in this service involves preparing the application to commence the matter in the SAT, liaising with client as required', filing the application.
Following that, there are additional services that Bayside Legal can provide such as ongoing representation, requesting the Matter Book, reviewing and providing an assessment and summary of issues along with legal advice on these matters, supporting or shadowing a client during this process and either supporting a client in preparation for the hearing, attending with the client or representing the client at the hearing.
These additional scopes can be discussed and fees are provided accordingly.
Trust Deeds
This service includes taking instructions, provision of advice, preparation of deed, consultation and review, finalisation and execution of document - from $1,200.00.
Family Provision Claims / Claims against an estate or a will.
Initial consultation which includes identification of legal matters and preliminary advice. Fee for initial consultation (approx: 1 hour consultation) $495.00.
Estimate for undertaking the matter to be provided at the conclusion of the initial consultation.
At Bayside Legal, all matters require initial consultations
Our practice meets with all clients, in person or via Teams/Zoom, prior to commencing all legal matters. This allows clients to:
meet the lawyer that will potentially be working on their matter;
to receive preliminary legal advice and guidance on matters;
to scope out the matter and provide an estimate of the fees for the work involved in their matter;
and to have any questions answered.
Following the initial consultation, we will send you an email which will:
advise whether our practice has capacity to take on a client’s matter;
we provide a summary of what was discussed during your initial consultation, including any recommendations; and
we confirm whether, or not, we have capacity to take on your matter.
If we can take on your matter, your email will confirm the proposed scope of work and the estimated fees for that work. If you wish to proceed, a costs agreement will be prepared for you to sign before we commence working on your matter.
If we do not have capacity to take on your matter, we can usually offer recommendations for someone who may be able to assist you.
Kindly note that 10% GST is charged in addition to fees set out above.
